We invite you to read our General Conditions of Sale and Use (“CGV/CGU”) before using our AMI For Ever website accessible via https://ami.forever.com (the “Site”) , to send us one of your Ami products to benefit from our Take-back service or to order a second-hand product available on the Site. Please note that any service provided on the Site implies full acceptance of these General Terms and Conditions.

The General Terms and Conditions apply between you, as a consumer and not a professional, and us, the company AMI PARIS whose head office is located at 54 rue Etienne Marcel, 75002 PARIS, registered in the Paris Trade and Companies Register under Paris RCS number 527636609, VAT number FR13527636609. Note that these General Terms and Conditions are subject to change as we reserve the right to modify them at any time depending on changes to the Site and/or regulations. We would like to point out to you that these are the General Terms and Conditions in force at the time of your Pick-up and/or your Purchase which will apply to you.

1. Your customer account

In order to benefit from our take-back service for one of your Ami products (sell your second-hand products) or to order a second-hand product available on our Site (buy a second-hand product), you must create an account AMI For Ever customer (different from your customer account on the site www.amiparis.com) via the “Create an account” section of the AMI For Ever Site.

Creating your account allows you:

  • to provide your personal information in order to facilitate your sales of AMI products or your future orders of second-hand products;
  • to consult, modify and update your personal information;
  • to identify yourself before putting one of your products on sale or ordering a product available on the Site;
  • consult your electronic wallet and convert your credits into a voucher;
  • track your current purchases and view invoices for your past orders.

By using the Site, you confirm that you are an individual residing in mainland France (Corsica included), and wish to benefit from our take-back service or purchase an Ami product for personal purposes in quantities corresponding to the usual needs of a consumer's household. Under no circumstances may our Site be used by professional “clients”. We reserve the right to refuse an offer for sale or a purchase which is clearly validated by a professional customer.

You are responsible for maintaining the confidentiality of your AMI For Ever Customer Account and your password, as well as restricting access to your computer or other equipment. As such, you acknowledge that you are responsible for all activities emanating from your AMI For Ever customer account. If you suspect that your customer account is being used by a third party, we recommend that you change your password and contact us to close the usurped customer account if necessary by contacting us via the address provided here (Please note, please specify the AMI For Ever object for all your requests so that they are redirected to the right service.).

2.Sell your products: our take-back service for your Ami products

2.1 Which product can I return an AMI product via the Site?

You can send us your products which we will then put on sale on the Site, by going to the “Sell” section. Only AMI products may be offered for sale on the Site, it being specified that the brand label must be visible. Products without a brand or whose interior composition label (containing the item reference number) is cut off are therefore not accepted.

Furthermore, the Site only lists products whose types and sizes are defined in the list made available in the automatic recovery module accessible in the “Sell” section of the Site.

By requesting to benefit from our take-back service for your Ami product, you declare:

  • Be the owner of this product and reside in mainland France (including Corsica)
  • Have the legal capacity and all necessary authorizations to offer the product for sale
  • Commit yourself contractually to the veracity of the information given when requesting a return of your product
  • Provide all necessary information on the quality and condition of the product
  • Do not send counterfeit products: the Site may request a certificate of authenticity to verify the information you provide. We reserve the right to verify the authenticity of the products you wish to have returned and we will refuse a product if we consider it to be counterfeit. Thus, upon simple request from us, you must provide us with the original copy and/or an electronic copy of any element capable of proving ownership of the product as well as its authenticity.

In addition, any AMI product for which you wish to benefit from our take-back service must be in one of the following states:

  • New condition: the product has never been worn. It still has its original label.
  • Excellent Condition: the product is practically new, with no signs of wear or visible defects.
  • Very good condition: the product shows only minor signs of wear.

Before sending your product, check that it has no defects, holes or stains or any signs of wear such as scratches, and that it falls into one of the 3 categories above. No product sent to us will be returned. It is your responsibility to ensure that your product meets the return criteria.

We will check upon receipt of your product that the category you entered in the return module is consistent with the condition of your product and that it still has its brand label and interior label. If this was not the case:

  • The amount of your voucher will be reduced to correspond to the actual condition of the product if it remains in one of the categories above allowing it to be resold on the Site
  • No purchase voucher will be granted to you if we notice upon receipt that your product has fatal defects which do not allow it to be offered for sale on the Site and the product will not be returned to you

2.2 How to benefit from our take-back service for your AMI products?

To benefit from our take-back service for your AMI products, nothing could be simpler!

  • Go to our Site and select the “Sell” section;
  • Indicate the characteristics of your product by filling in the fields accessible in the “Sell” section of the Site then obtain an estimate of our Trade-in Offer for your product using the automatic calculator. This estimate is based on internal criteria (such as product type, original value, declared condition, etc.) and is generated automatically. Please note, the amount of the Purchase Voucher that you will receive will not necessarily correspond to this estimate (see below).
  • Once your recovery request procedure has been finalized and you have accepted these CGV/CGU, click on “Continue”;
  • Log in to your AMI For Ever customer account on the Site, or create your AMI For Ever customer account on the Site if you do not already have one;
  • Validate your recovery request
  • The Chronopost label to send the package as well as the delivery slip are sent to you by email, print these two documents
  • Prepare your package by adding the previously signed delivery slip, affix the label to the package and ship it free of charge by Chronopost. You can drop off your package at a Post Office, Pickup relay or Chronopost Agency.

Once your package has been received by us, we will verify it within 15 days. You will then receive an email confirming whether or not your product has been accepted and the amount of the associated credit.

If it appears that the announced condition of your product does not correspond to the reality of its condition (which would be the case for example if you indicated in the Sales module that your product was in “New condition” whereas it is in “Very Good Condition”), then the amount of the associated credit will be reduced compared to the trade-in offer estimated by our automatic calculator, without you being able to request a return of the product.

If your package unfortunately does not arrive at our address or is damaged during transport, we will let you open a complaint with Chronopost. No claim or compensation may be required from AMI.

2.3 What happens if the condition of my product is deemed insufficient to be sold on the Site?

If your product is refused because it is deemed to be in “poor condition”, i.e. it has crippling defects which do not allow it to be sold on the Site, such as hole(s), stain(s). s), scratch(es) or defect(s) altering one or more of its functionalities), you will be informed by email at the latest within the month following shipment of your product.

In the event of a product in “poor condition”, which cannot therefore be resold on the Site:

  • No voucher will be given to you;
  • The refused product will not be returned to you, it will be given to an association or will be part of an upcycling process.

2.4 What is the amount of credit associated with the recovery of my Ami product by the Site?

Once your product has been validated by our services, you will receive the amount of your credit directly in your Member Area on the Site.

We remind you that the amount of the credit may be different from the offer communicated to you by the automatic simulator in the event that we consider that your product does not conform to the condition you indicated. Your product will not be returned to you.

2.5. How do I use my voucher?

The amount corresponding to your returned items will be credited to your electronic wallet. This is accessible in your customer account in the “My credits” section.

You can at any time request to convert all or part of your electronic wallet into a voucher that can be used: on the AMI Paris website (as a promotional code), on the AMI For Ever website (as a promotional code) or in the network of eligible AMI stores (in the form of a voucher that you will receive by email and which you must present in store). The list of eligible AMI stores is as follows:

  • AMI Saint-Honoré
  • AMI Beaumarchais

Please note, once the conversion has been carried out from your electronic wallet, your Purchase Voucher will be usable exclusively and only according to the choice made (website www.amiparis.com, AMI For Ever website or store).

Your purchase voucher will be generated no later than 72 hours following your request. You will receive a confirmation email containing your Voucher.

Your voucher is valid for a period of 12 months. When used, it may be split (partial use of its value in several installments).

Please note that your voucher cannot be exchanged or refunded for cash.

In the event of permanent shutdown of the Site, if your electronic wallet still has credit, you will no longer be able to use this credit to purchase products on the Site. The amount of this credit will then be automatically converted into a promotional code usable on the Site www.amiparis.com, you will be notified by email.

3. Buy products: ordering a second-hand AMI product on our Site

You can order your favorite second-hand products directly on our Site in the “Buy” section. All products offered for sale are second-hand Ami brand products that have been subject to quality control and reconditioning by us: manual inspection by our quality experts, repair on a case-by-case basis if necessary, wet or dry cleaning and ironing. Signs of wear on products and/or repairs carried out on a product are explicitly mentioned on the product sheets.

Product and price offers are valid as long as they are visible on the Site, while stocks last.

3.1 How to order a product on the Site?

To order, nothing could be simpler!

  • Select your product, check that the size of the item suits you and add it to the cart. At any time you can check the number of products contained in your basket and obtain detailed information on each of them by clicking on “Basket”. After adding a first item to your basket, you can continue your purchases by clicking on “Continue shopping”;
  • Once your basket is finalized, click on “Finalize my order”;
  • Log in to your customer account or create your customer account if you do not already have one, or continue as a guest;
  • Complete your delivery address;
  • Choose your payment method (see the article “How to pay for your order?” for more information on payment methods), read and accept all of the General Terms and Conditions and proceed to secure payment. your order. Payment for your order implies full acceptance of these General Terms and Conditions;
  • Your order is validated! You will receive an email confirming your order.

By placing an order, you declare that you are at least 18 years old and have the legal capacity (or if you are a minor, to have parental authorization to place your order).

Once your order has been prepared by us, you will receive an email informing you of the shipment of your items. You will then be able to follow the delivery status of your order using the tracking information contained in the email and in your Member Area. If you do not receive any email (neither confirmation nor shipping of your order), you can contact us for more information.

It may happen that we are forced to cancel your order for a legitimate reason, for example:

  • when you have been able to place an order while your product is in the meantime unavailable: we will inform you as quickly as possible and reimburse you the amount of your item as soon as possible;
  • when a technical error appears during your payment;
  • when an obvious error has crept into the product sheet (for example when there is an error in the essential characteristics of the product, or when a clearly incorrect price is displayed);
  • when we notice fraudulent or abusive use of your account or related orders;
  • when we reasonably consider that you have violated our present General Terms and Conditions.

3.2. Prices of AMI For Ever products

The prices of our second-hand products are indicated on the Site in euros, all taxes included (TTC), excluding shipping costs (which will be specified to you when you validate your delivery method). Prices are determined based on their condition (see article 2.1. for more information on the different conditions of the products). They take into account Value Added Tax (VAT) and any reductions applicable to our commercial operations in force on the day of your order.

3.3. How to pay for your order?

Payment for your order is made directly online by bank card (CB, Visa, MasterCard, American Express), or via a purchase voucher (amount credited to the electronic wallet of your customer account if you have benefited of our take-back service, only one voucher usable per order).

After confirmation of your payment by our payment provider, your bank account will be debited for the total amount of your order. If a voucher is used, it will be debited for the amount of your order.

We would like to reassure you that all your transactions are secure and comply with the legal provisions in force: they take place within a strict framework of confidentiality and encryption of all your data with our payment provider.

We do not at any time have access to your personal data concerning your means of payment, in particular bank cards, and do not store them on our servers.

3.4 Delivery of your order

3.4.1 Where and how can you be delivered?

Your orders can be delivered to you in mainland France (including Corsica) only using the following delivery method:

  • Standard home delivery: have it delivered directly to the address of your choice
  • Delivery to a relay point: have it delivered to a La Poste relay point near you

You will be able to follow the delivery of your order, upon receipt of the email confirming the shipment of your order with the information relating to tracking.

In the event of absence during the delivery of your order, for home deliveries, a delivery notice will be given to you in order to give you the arrangements for collecting your order.

3.4.2 When will you be delivered?

We will do our best to deliver to you as quickly as possible.

  • Belgium/Spain/Italy/Germany/Netherlands: 5 to 7 working days
  • France: 3 to 5 working days

Please note that it may be extended during busy periods for carriers. In the event of delay or lack of delivery, we invite you to contact us via the address provided here. (Please note, please specify the subject AMI For Ever for all your requests so that they are redirected to the correct service).

FEES

  • Belgium/Spain/Italy/Germany/Netherlands: delivery costs are €5 for delivery to a relay point and €7 for home delivery without signature.
  • France: delivery costs are €4 for delivery to a pick-up point and €6 for home delivery without a signature required.

3.5 What are our return and refund terms?

In accordance with European regulations, you have a withdrawal period of 14 days from receipt of your order to notify us of your wish to return any product that does not suit you. You must then return your product without undue delay and at the latest within 14 days following the date of your withdrawal.

You can print your return slip by going to the “My orders” section of your AMI For Ever customer account. You must then return your products to us within 14 days of this notification, the return costs will be your responsibility.

3.5.1 How to return your order to us?

The products you wish to return to us must be in their initial condition, without having been damaged, stained, washed, modified or worn (with the exception of trying on), attaching the original packaging and all accessories relating to the products. Items, such as packaging, labels, as well as the original invoice.

Since returns to the store are not available for second-hand products, you can only return your product to us by post, using the following procedure:

  • Go to your Member area to print the delivery slip to make your return as well as the prepaid label
  • Check the product(s) you wish to return on the delivery note;
  • Insert this delivery note in your return package as well as the product(s) to be returned;
  • Stick the prepaid label (– please note return costs are your responsibility, the amount of the prepaid label will be deducted from the reimbursement of your product).;
  • Drop off your return package at the post office within a maximum of 14 days from your return request.

3.5.2 When will you be reimbursed?

Once your return has been verified by our services, you will receive a refund confirmation email.

We undertake to reimburse you the amount corresponding to the returned product(s), less return costs, as soon as possible and at the latest within 14 days following the date of receipt of your return in our warehouses, or providing proof of shipping of your return.

Your refund will be made directly to the account linked to the bank card used to pay for the order and/or re-credited to the electronic wallet of your AMI For Ever Customer Account if you used a voucher during checkout. your purchase. You will receive a refund confirmation email once it is validated by our systems. You will be able to follow the progress of the stages of your return directly in your customer area, “My orders” section.

Any return of a product which does not conform to the condition in which it was sent to you and which is on the contrary worn and/or soiled and/or damaged will be returned to you and will not give rise to a refund.

3.6. What guarantees for your products?

Our products benefit from legal guarantees, that is to say the legal guarantee of conformity and the guarantee against hidden defects. As a seller, we are effectively required:

1. defects in the conformity of the products you purchase, under the conditions of article L.217-4 et seq. of the Consumer Code. The legal guarantee of conformity applies when your product presents a lack of conformity, for example when your product does not function in accordance with the uses for which this product is usually used, or when it does not correspond to the description given;

2. and its hidden defects under the conditions of article 1641 et seq. of the Civil Code. The hidden defects guarantee covers you when your product contains a hidden defect, that is to say a defect not apparent at the time of purchase which makes the product unfit for its use or which very significantly reduces this use.

Please note that the legal guarantee of conformity and the guarantee of hidden defects cannot be applicable in the event of misuse of your products or non-compliance with the maintenance conditions of your product (provided on our labels or by our retouchers).

If you act under a legal guarantee of conformity, you:

  • benefit from a period of two (2) years from delivery of the product to act;
  • can choose between repair or replacement of the product, subject to the cost conditions provided for by article L.217-9 of the Consumer Code;
  • are exempt from providing proof of the existence of the lack of conformity of the goods during the six (6) months following delivery of the goods, with regard to second-hand products, this period being extended to 12 months from the 1st January 2022.

The legal guarantee of conformity applies independently of any commercial guarantee granted.

You can decide to implement the guarantee against hidden defects within the meaning of article 1641 of the civil code. In this case, you can choose between canceling the rental or reducing the sale price in accordance with article 1644 of the Civil Code.

4. Your Personal Data

We treat your Personal Data with the greatest vigilance and confidentiality.

5. Liability and force majeure

We undertake to describe with the greatest accuracy the second-hand products that we sell on the Site and to ensure that the information disseminated there is updated in the best possible conditions.

We cannot be held liable in the event of failure to fulfill one of our contractual obligations resulting from a case of force majeure as defined by the regulations. In particular, we will not be held responsible for any non-execution or delay in the execution of your orders, caused by events beyond our control, such as:

  • Strikes, closures or other industrial actions;
  • Civil unrest, riot, invasion, terrorist attack or threat of terrorist attack, war (declared or not), or threat or preparation for war;
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic and pandemic or other natural disasters;
  • Inability to use transport by rail, boat, plane, road or other private or public means of transport;
  • Inability to use public and private telecommunications networks;
  • Acts, decrees, legislation, regulations or restrictions of any government (e.g. administrative closure of stores);
  • Failure or accidents of maritime, postal or other transport.

The execution of the General Terms and Conditions will be suspended for as long as the force majeure event lasts and the execution and delivery times will be extended accordingly. Please note, however, that we will do our best to put an end to the force majeure event or find a solution allowing us to perform our contractual obligations despite the force majeure event.

6. What if we disagree?

We don't want to, but we may disagree!

Please note that our CGV/CGU are subject to French law, and that your sales and purchases of second-hand Ami products on the Site are subject to the CGV/CGU in force on the day of your sale or order.

In the event of a dispute, we invite you to contact us in order to find an amicable solution together.
